habib assalamualaikkum syahab blessed God,

here I want to ask about problems experienced by my friend,

please would habib be helping the problem.

I have a female friend of a civil servant, he was married to a military, marriage blessed with a child.

My friend often tells to me via email that he always kept with her husband's noisy, to the extent that her husband spoke to divorce him so easily, although he was hard to accept. I was trying to calm my friends and support it so that he remain patient and maintain a household.

My friend here wants to make sure that habib status, whether the religion he was legally divorced? because my friend wanted to take care of it in state law. sedangakan he was a military wife and is still in Papua, he could not part with her husband and this applies to military families. He wanted to start a new life with her son, but he has not dared to divorce if there has been no clear status of religious law.

I hope habib could help my friend this difficulty in Papua,

I am waiting for an answer as soon as possible Habib,,

habib syahab hopefully always in lindunganNYa SWT ..

yours respectfully

Waalaikumsalam, brothers who glorified Allah,

Separations were two in terms of wording

1. Separations sharih (explicitly stated) and divorces kinayah (with sarcasm).
Separations divorce sharih is understood from the meaning of words when expected, and does not contain the possibility of other meanings. For example, "you have tertalak and sentenced to divorce you, or you divorce me, all the sentences that come from lafazh talaq.
then fell divorce, either joking, playful or without intention. This conclusion is based on the hadith of Abu Hurairah ra from the Prophet, he said, "There are three things in earnest, so serious and the joke so seriously (too): marriage, divorce, and reconciliation.
2. Kinayah talaq, is talaq talaq which means that requires intent. For example "you go back home your parents or any sentence that is in the form of satire
And divorce laws divorce kinayah not happen, unless accompanied by the intention to divorce. So if the husband accompany it with the intention of saying talaq divorces then fell and if not then divorce does not occur.

So my brother Divorce can not be made for a joke or a joke, what if her husband uttered talaq divorces then fell on his wife.

And the better the wife complained to the government prihalnya local religion.

And we kind of thought you dream alone with God and surrender everything to Allah, and hopefully your intent facilitated Allah.
